1. Acceptance of Terms
By accessing or using 99Visibility (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
99Visibility is a Generative Engine Optimization (GEO) platform operated by Torch99. The Service audits how AI platforms — including ChatGPT, Perplexity, Google AI, and Claude — describe your brand. Key features include:
- Visibility scoring across multiple AI platforms
- Hallucination and inaccuracy detection
- Prescriptive, actionable recommendations to improve your AI visibility
- Competitor comparison and benchmarking
3. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information during the registration process
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, to create an account and use the Service.
4. Subscription Plans and Billing
All payments are processed by Stripe, Inc. ("Stripe"), who acts as our payment processor for all subscription transactions. This means Stripe is the entity that processes your payment, handles sales tax and VAT, and issues invoices on our behalf.
99Visibility offers the following subscription tiers:
- Starter — $49 per month
- Growth — $99 per month
- Pro — $149 per month
Prices are listed in USD. Stripe may display equivalent amounts in your local currency at checkout. Applicable taxes (sales tax, VAT, GST) are calculated and collected by Stripe based on your location.
All subscriptions are billed monthly through Stripe. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. Prices are subject to change with at least 30 days' prior notice. Any price changes will take effect at the start of your next billing cycle following the notice period.
You can manage your subscription, update payment methods, and view invoices through the Stripe Customer Portal, accessible from your account settings.
5. Founding Member Program
The first 100 registered users who complete onboarding ("Founding Members") receive access to Starter-tier features at no cost for the lifetime of their account. "Lifetime" means for as long as (a) the Service continues to operate, and (b) the Founding Member's account remains active. Accounts inactive for 12 or more consecutive months may lose Founding Member status after written notice. Founding Member benefits are non-transferable and limited to one account per individual.
6. Free Trial
99Visibility may offer a 7-day free trial or one complimentary audit at no cost. No credit card is required to start a free trial. At the end of the trial period, your account will only convert to a paid subscription if you explicitly choose a plan and provide payment information. We will not charge you without your consent.
7. Refund and Cancellation Policy
Refunds are managed by Stripe in accordance with their refund policies.
We offer a 14-day money-back guarantee on new paid subscriptions. If you are not satisfied within the first 14 days, contact us at info@99visibility.com and we will process a full refund through Stripe.
You may cancel your subscription at any time through the Stripe Customer Portal or your account settings. Upon cancellation, your subscription remains active until the end of your current billing period. You will not be charged for subsequent billing periods.
Unused audit credits do not roll over between billing periods and are not eligible for refund.
8. Data Collection and Usage
In order to provide the Service, we collect and process certain information, including:
- Brand information you provide (domain, brand name, description)
- Queries you configure for auditing
- Audit results, visibility scores, and AI platform responses
- Account and usage data
- Payment transaction data received from Stripe (subscription status, plan tier, transaction IDs — we do not receive or store your payment card details)

9. Acceptable Use
You agree not to use the Service to:
- Engage in any activity that is illegal or violates applicable laws or regulations
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or use automated tools to extract data from the Service without authorization
- Resell, redistribute, or sublicense the Service or any data derived from it without written permission from Torch99
- Interfere with, disrupt, or place an undue burden on the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service or its related systems
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions, at our sole discretion and without prior notice.
10. Intellectual Property
The Service, including all content, features, and functionality (such as text, graphics, logos, software, and design), is owned by Torch99 and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
You retain full ownership of any brand data, queries, and other content you provide to the Service. Audit results generated by the Service may be freely used by you for your own business purposes, including internal reporting and strategy.
11. Third-Party AI Platforms
The Service queries third-party AI platforms, including those operated by OpenAI, Anthropic, Google, and Perplexity, in order to generate audit results. Please be aware of the following:
- We are not responsible for the content, accuracy, or availability of responses from third-party AI platforms
- AI platform responses may change at any time without notice, which may affect your audit results
- We do not control how third-party AI platforms generate, rank, or present information
- Third-party AI platforms are subject to their own terms of service and policies
12. Third-Party Payment Processing
All payment processing for 99Visibility is handled by Stripe, Inc., who acts as the Merchant of Record. By subscribing to a paid plan, you agree to Stripe's Terms of Use and Privacy Policy.
Stripe is responsible for:
- Processing payments and issuing refunds
- Calculating and collecting applicable taxes (sales tax, VAT, GST)
- Generating and delivering invoices
- PCI DSS compliance for payment card handling
- Handling payment disputes and chargebacks
Torch99 does not store, process, or have access to your payment card details. All payment information is handled exclusively by Stripe's secure, PCI-compliant infrastructure.
13. API Usage
API access may be available on certain subscription plans, subject to the following conditions:
- API usage is subject to rate limits as specified in the applicable plan documentation
- You must not use the API to build, support, or contribute to any product or service that competes with 99Visibility
- API keys are confidential and must not be shared or exposed publicly
- We reserve the right to revoke API access for misuse or violation of these Terms
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Torch99 does not warrant that:
- The Service will be uninterrupted, secure, or error-free
- AI platform responses captured by the Service are accurate, complete, or reliable
- Audit results or recommendations will achieve any specific outcome for your brand's visibility
- The behavior of third-party AI platforms will remain consistent over time
AI platforms may change their models, training data, or response behavior at any time, which may affect the results and recommendations provided by the Service.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Torch99 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
In no event shall Torch99's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the total amount you have paid to Torch99 in the twelve (12) months immediately preceding the event giving rise to the claim.
16. Termination
Either party may terminate this agreement at any time:
- You may cancel your subscription at any time through the Stripe Customer Portal or your account settings
- We may suspend or terminate your account if you violate these Terms, with or without notice
Upon termination, your right to access and use the Service will cease immediately. Your data will be retained for 30 days following termination, after which it will be permanently deleted. You may request an export of your data during this 30-day period by contacting us.
17. Changes to Terms
We reserve the right to modify or replace these Terms at any time. When we make material changes, we will provide at least 30 days' notice via email or in-app notification before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Torch99 is established, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.
For payment-related disputes, Stripe's dispute resolution process may apply as set forth in Stripe's Terms of Use.
